Lack of Discrimination Inquiry Not Retaliation, Court Rules
A federal appeals court has ruled that an employee cannot bring a retaliation claim against her employer for failing to investigate a racial discrimination claim. The court held that the failure to investigate in itself could not be viewed as retaliation for the employee’s underlying bias claim, as was alleged.
