New York Appeals Court Declares Defense of Marriage Act Unconstitutional
In a 2-1 ruling handed down Oct. 18, the 2nd Circuit U.S. Court of Appeals in Manhattan said the Defense of Marriage Act unfairly prevents same-sex couples from enjoying economic benefits afforded to heterosexual couples, including the right to file joint federal tax returns or collect a spouse's Social Security after death.
